A STATE parliamentary committee has exonerated a Liberal MP accused of misleading parliament over an altercation with Northcote MLA Fiona Richardson's supporters last year, despite key witnesses not being interviewed.
The Privileges Committee concluded its investigation of Mount Waverley MLA Michael Gidley last month, finding three complaints made against him could not be substantiated.
The committee interviewed Mr Gidley and Ms Richardson over the June 29 incident, but not staff member Jesse Martin and his girlfriend Katherine Munt.
Channel Seven reporter Brendan Donohoe, who partially witnessed the exchange, was also not interviewed.
The investigation followed claims Mr Gidley was aggressive towards Mr Martin and Ms Munt when they were handing out flyers criticising the state government over its public transport policies.
There are conflicting reports of what happened next, with Mr Donohoe telling Fairfax Media Mr Gidley yelled at the pair "quite loud" and took their photo. Mr Gidley denied the claim in an address to parliament later that day.
Ms Richardson accused Mr Gidley of misleading the house over his statement.
Mr Martin said he did not know why the committee did not ask him to discuss the events.
"We assumed we would be called at a point in time, but we never were," he said.
The bipartisan committee, which has five Liberal members and four from the ALP, stated in its report that "...the terms of the allegation and the evidence presented to the Committee did not establish any reasonable prospect that the Committee could conclude that the Member for Mount Waverley deliberately misled the House."
Mr Gidley maintained his version of events when contacted by MTW.
"I did not mislead the House, and as I said at the time Labor raised this allegation, I was happy for this to be examined by the Privileges Committee. I am pleased that the Committee found I had not misled the House," he said.
